is it identity theft if someone uses your picture but uses a different name?

a girl on myspace is using a lot of my pictures but she’s not using my name.. is it identity theft?

яαєlчnn. June 7, 2010 at 11:27 am: Yes, there was an article about it in People magazine. Because not everyone uses their real name on Myspace. People interpret the picture as you, whether or not its your name.

Sasha June 7, 2010 at 12:33 pm: People normally talk about ‘identity theft’ in the sense that it leads to fraud – e.g. someone using your name to run up debts in your name etc. See the article about identity theft below.

However, that doesn’t mean that it’s ok someone is using your photo on MySpace. I would email someone at MySpace to report that person – they should be able to block their account.
